Thank you for choosing Sweets and Treats by Kay for your special occasion!
This policy represents the agreement between Sweets and Treats by Kay, LLC. (“us”, “we”, “our”) and the Customer (“you”, “parties” “party” “individual”)
PLEASE READ POLICY
By making a payment towards your order, you are agreeing to this policy. Accordingly, YOUR PAYMENT SERVES AS A SIGNATURE FOR THE AGREEMENT OF THIS POLICY.
An invoice will be sent to be reviewed (date, cake flavor, filling, size, design, quantity, etc. of items that have been ordered). Conformation as well a picture of the order will be sent when the order is completed the day before the event for approval. The final decision is made by both parties on the final look. NO CHANGES on the order will be made the day of the order will be picked up/delivered.
If you do not agree to any of the previous herein, you are welcome to decline the order. Please keep in mind this policy is strongly enforced at Sweets and Treats by Kay, LLC.
1. COVID-19
Due to ever changing of COVID-19, federal, state, and local governments through their health agencies have issued several directives which prohibit congregations of groups of people. This has been caused by the fact that COVID-19 is highly contagious and has been proven to spread through person-to-person contact. Considering the foregoing, in the circumstance your event is canceled, postponed* or rescheduled due to COVID-19 related directive issues by any government entity, we will honor your payment as a credit to another service up to 1 (one year). You are free to use this credit for any upcoming event, however the date must be subject to Sweets and Treats by Kay calendar.
*For the purpose of this clause, to postpone shall mean to put off an event, or an appointment while rescheduling again with a new date and time set.
2. DEPOSIT
2.1 - A 50 % NON-REFUNDABLE deposit/full payment is due at the time of the order is placed to secure your date for your event
2.2 - Your order is NOT confirmed till a deposit/ payment is received.
2.3 - Your spot on the date of your event may be issued to another client in the event your deposit is not received
3. REFUNDS
In no event shall we be required to refund any payment charged for any Order. The sole remedies available to you in the event of you canceling the order, or your event is postponed or rescheduled will be appointed as a credit on a future invoice.
4. FINAL PAYMENT
Final payment MUST BE MADE ONCE the order has been sent to you via photo for approval.
5. CHANGES
Any changes to the order such as date, time, location should be notified to us within 48 hours of delivery/pick up. We may amend the Policy at any time. The revised will be effective at the time we post it.
6. DISCLAIMER
Our kitchen is NOT NUT FREE! Our products may contain or come in contact with milk, wheat, nuts, soy & other allergens. You agree to notify your guest of this risk & hold us harmless for allergic reactions.
7. YOUR OBLIGATION(S)
You are responsible for providing an appropriate and secure table/surface and environment for your order. Kindly do not place your cake outside for any outdoor event. ALL CAKES MUST BE KEPT IN THE FRIDGE TILL SERVING. Once the item is handed off, it is no longer our responsibility for that order. Cake stands are available upon request for rental. Rental fees and deposit are required. Deposit will be refunded back when the stand is returned in proper condition. If there is any damage to the stand the deposit will not be refunded back to the consumer.
8. PACKAGING
At pick up your item will be boxed up and secure for travel back to your destination. PLEASE make sure your vehicle has room and preferably a flat surface to sit the item down. All information regarding traveling with your item will be posted on the box/ spoken with you.
9. LIMITATION OF LIABILITY
In no event will we be liable to you for any indirect, direct, incidental, special, consequential, or punitive damages arising out of or relating to the order once it leaves Kayla’s or the staff’s possession.
10. COLOR MATCHING, ARTIST DESIGN AND DESIGN CHANGE
In the course of designing the cake, if there is need for additions or reductions; Kay has the absolute discretion to make the said changes and/or alterations in order to complete the cake. As you are aware, photos of inspiration or welcome. However Kay cannot do the exact replications of the design requested from another cake artist. Colors will be matched as close as possible
11. CHANGES TO INVOICE
You understand that invoices are FINAL. NO CHANGES CAN BE MADE THE DAY BEFORE DELIVERY/ PICKUP. A COPY OF INVOICE WILL BE SENT VIA TEXT OR EMAIL. It is your responsibility to make sure all details are correct before submitting payment.
12. SICKNESS
You acknowledge that Kay has the right to cancel the order in the event she becomes ill or has a family emergency. The client will be contacted and informed of the same as soon as humanly possible. In addition, the Client will receive a refund ONLY in such circumstances.
13. SERVING SIZE
The guest servings for the cake will be exact per inquiry form. Sweets and Treats by Kay will not be responsible for cake shortage.
14. ALLERGY RESPONSIBLE
You understand that it is your responsibility to inform Kay prior to booking the order if there are any allergy concerns.
